Endangerment of a Protected Structure
If, in the opinion of the Council, a Protected Structure is becoming or continuing to be endangered, the City Council shall serve a notice on each person who is the owner or occupier of such an endangered protected structure specifying the works considered necessary and requiring the person on whom the notice is served to carry out the works within a specified period of not less than 8 weeks from the date of notice.
The City Council may also serve a notice to require restoration of character of the protected structure including the removal, alteration or replacement of any specified part or element of the structure and the removal or alteration of any advertisement structures.
The carrying out of any works specified in this notice shall be exempted development.
A person on whom a notice is served may, within 4 weeks, make written representations to Galway City Council relating to:
- Terms of the notice
- Provision of assistance
- Any other material considerations.
If subsequently a person on whom a notice is served is dissatisfied they may appeal against the notice to the District Court within two weeks after being notified.
A person who fails to comply with a notice served shall be guilty of an offence.
Where a person fails to comply with a notice served, Galway City Council may:
- Enter on the land and carry out or arrange to carry out the works specified in the notice
- Recover any cost/expenses incurred in assisting or carrying out the necessary works.
A local authority has powers to acquire, by agreement or compulsorily, a protected structure if it considers that this is necessary in order to protect the structure.
