NOTICE OF THE CONFIRMATION BY GALWAY CITY COUNCIL OF A COMPULSORY PURCHASE ORDER MADE UNDER SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT(NO.2) ACT, 1960, (AS SUBSTITUTED BY SECTION 86 OF THE HOUSING ACT, 1966 AND AS AMENDED BY SECTION 6 AND THE SECOND SCHEDULE OF THE ROADS ACT 1993 (AS AMENDED ) AND THE PLANNING AND DEVELOPMENT ACT 2000 ( AS AMENDED) AND SECTION 213 OF THE PLANNING AND DEVELOPMENT ACT, 2000 (AS AMENDED) AND SECTION 184 OF THE LOCAL GOVERNMENT ACT 2001 AS RESPECTS ALL OF THE LANDS TO WHICH THE COMPULSORY PURCHASE ORDER RELATES, TO BE PUBLISHED IN ACCORDANCE WITH SECTION 78(1) OF THE HOUSING ACT, 1966, AS AMENDED BY THE PLANNING AND DEVELOPMENT 2000 (AS AMENDED).

COMPULSORY ACQUISITION OF LAND

Galway City Council Bothar Na Choiste Road Improvement Scheme

Compulsory Purchase Order No. BnC-CPO-001, 2021

in the City of Galway

 

 

Galway City Council has, on the 23rd May 2022, made a Confirmation Order confirming without modification the above-named Compulsory Purchase Order as respects the land described in the Schedules hereto.

 

The Compulsory Purchase Order provides, inter alia, that, subject to the provisions of same, the local authority are authorised:

  • to acquire compulsorily for the purpose of the construction and widening of approx. 516 Km of public road in the townland of Castlegar in the City of Galway, together with all ancillary works associated therewith, and for the purposes of providing infrastructure to facilitate walking and cycling, the lands described in Part 1 and Part II of the Schedule hereto which land is shown coloured grey on the map, Drawing No. 10750-4000, and marked “Galway City Council, Bothar na Choiste, Compulsory Purchase Order No. BnC-CPO-001, 2021”, and sealed with the seal of the local authority and deposited at the offices of the local authority (hereinafter referred to as “the deposited map”);
  • to extinguish the public rights of way described in Part III of the Schedule hereto by order made after the acquisition of the land, where the said public rights of way is over the land so acquired or any part thereof, or over land adjacent to or associated with the land so acquired or any part thereof, and
  • to acquire the rights as described in Part IV of the Schedule.

 

The said Order, as so confirmed, authorises Galway City Council to acquire the land compulsorily described in the Schedules hereto.

 

A copy of the order as so confirmed and of the map referred to in it may be inspected:

  • on Galway City Council website at the links below and,
  • at the Planning Office of Galway City Council, City Hall, College Road, Galway, H91 X4K8 from 9am to 4pm Monday to Friday, excluding public holidays.

The order, as so confirmed, will become operative three weeks from the date of publication of this notice.

 

An application for judicial review of the decision of Galway City Council under Order 84 of the Rules of the Superior Courts may be made to the High Court within eight weeks of the date of publication of this notice in accordance with section 50 of the Planning and Development Act 2000, as amended.
